Welcome to Tend
These Terms of Service ("Terms") govern your use of the Tend mobile application ("App"). By using Tend, you agree to these Terms. If you don't agree, please don't use the App.
Who can use Tend
Tend is intended for users aged 13 and older. By using the App, you confirm that you meet this age requirement. If you are under 18, you should have your parent or guardian's permission to use Tend.
The service
Tend is a gratitude journalling app that provides:
- AI-powered personalised prompts and affirmations
- Local storage of your gratitude entries
- Optional location-based context (weather, seasons)
- Anonymous usage analytics (opt-out available)
The App is currently free during beta testing. We may introduce paid features in the future, which will be clearly communicated.
Your content
You retain all rights to your gratitude entries and reflections. Your content is stored locally on your device and is not accessible to us or other users.
You are responsible for:
- The content you create in the App
- Backing up your data (if desired)
- Understanding that deleted data cannot be recovered
Acceptable use
You agree to use Tend for its intended purpose: personal gratitude journalling and self-reflection. You will not:
- Attempt to reverse-engineer or hack the App
- Use the App for any illegal or harmful purpose
- Share or distribute content generated by the App's AI in a way that violates OpenAI's terms
- Use automated tools to access or manipulate the App
Third-party services
Tend uses third-party services to provide AI personalisation (OpenAI), analytics (Aptabase), and crash reporting (Sentry). Your use of these services through Tend is subject to their respective terms and privacy policies.
Disclaimers
Tend is provided "as is" without warranties of any kind. While we strive for accuracy and reliability:
- Tend is not a substitute for professional mental health care
- AI-generated content may not always be accurate or appropriate
- We cannot guarantee uninterrupted or error-free service
- You use the App at your own risk
Limitation of liability
To the maximum extent permitted by Austrian law:
- Sara Meindl is not liable for any indirect, incidental, or consequential damages arising from your use of Tend
- Our total liability shall not exceed the amount you paid for the App (currently €0 during beta)
- This does not limit liability for death, personal injury, or fraud
Changes and termination
We may:
- Update these Terms at any time (with notice in the App)
- Modify or discontinue features
- Suspend or terminate the App (with reasonable notice)
You may stop using Tend at any time and delete all your data from Settings.
Governing law
These Terms are governed by the laws of Austria. Any disputes shall be resolved in the courts of Austria (Niederösterreich jurisdiction).
